Spamhunter Ann Elisabeth got an e-mail from author of the referer-spamming tool Reffy, where he said he would stop using his own tool, because his ISP threatened to shut him down for using it. The apparent consensus seems to be that referer spamming tools fall under the same laws that regular e-mail spam does.
This apparently happened after someone had tracked down his real identity, and considered publishing it - knowing that he read it.
Applying pressure to spammers helps.
